These Terms of Service govern your access to and use of the websites operated by Veteran Health Network LLC, an Indiana limited liability company (VHN, we, us, or our), including myvhn.org and its subpages (the Site). Please read them carefully. If you enroll in a VHN membership, your membership is governed by the Client Services Agreement you sign at enrollment, which controls over these Terms with respect to the services it covers.
1. Acceptance of Terms
By accessing or using the Site, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Site.
These Terms apply to all visitors of the Site. They do not replace, amend, or supersede the Client Services Agreement executed by enrolled members. In any conflict between these Terms and an executed Client Services Agreement, the Client Services Agreement controls as to the membership services it governs.
2. Description of Service
VHN is a veteran-exclusive medical platform, coordination company, and case management service. VHN coordinates access to independently licensed medical professionals who evaluate a veteran's full health picture, assign diagnoses within their own professional judgment, document functional impact, and produce a complete medical record that belongs to the veteran. VHN coordinates the administrative, logistical, and clinical support infrastructure around those provider relationships and provides case management.
VHN does not practice medicine and does not employ the medical professionals in its network. Clinical services are delivered by independently licensed professionals under their own authority.
VHN does not prepare, file, present, or prosecute VA disability claims. VHN does not represent veterans before the Department of Veterans Affairs. VHN does not provide claims strategy or claims advice. Where a member requests it, VHN introduces the member to an independent VA-accredited representative as a courtesy benefit of membership. Any such representative operates independently, is not employed by or affiliated with VHN, and no compensation flows between VHN and any representative in connection with any introduction. Veterans are always free to work with any accredited representative or Veterans Service Organization of their choosing.
The Site itself is informational. Using the Site does not create a membership, a provider-patient relationship, or any professional engagement with VHN.
3. Eligibility
VHN's services are veteran-exclusive and are offered only to individuals who are at least 18 years of age. By using the Site, you represent that you are at least 18 years old. The Site and services are intended for users located in the United States.
4. User Conduct
You agree to use the Site only for lawful purposes. You agree not to:
- Provide false or misleading information through any form or communication with VHN.
- Interfere with or disrupt the operation or security of the Site.
- Scrape, harvest, or collect information from the Site by automated means without our prior written consent.
- Use the Site to infringe the rights of any third party or to violate any applicable law or regulation.
- Impersonate any person or misrepresent your affiliation with any person or entity.
5. Intellectual Property
The Site and its contents, including text, graphics, logos, page designs, and underlying code, are the property of Veteran Health Network LLC or its licensors and are protected by intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. No other rights are granted.
This section addresses Site content only. A member's provider-produced medical records, care plans, and clinical documentation are the member's own medical records and remain the member's property, as provided in the Client Services Agreement.
6. Disclaimers
The Site and its contents are provided for general informational purposes only and are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
Nothing on the Site constitutes medical advice. VHN does not practice medicine. Clinical opinions and medical documentation are produced by independently licensed contracted providers, not by VHN.
Nothing on the Site constitutes legal advice, claims strategy, or claims representation. VHN is not a law firm, is not a Veterans Service Organization, and is not a VA-accredited representative.
VHN does not guarantee any particular disability rating, VA approval, decision timeline, backpay amount, effective date, or claim outcome of any kind. The VA's decisions are entirely outside VHN's control.
You are encouraged to seek advice from appropriately licensed professionals for medical, legal, tax, or financial matters.
7. Limitation of Liability
To the fullest extent permitted by law, VHN shall not be liable for any indirect, incidental, consequential, punitive, or exemplary damages arising out of or related to your use of the Site.
To the fullest extent permitted by law, VHN's aggregate liability arising out of or related to the Site shall not exceed the greater of the amounts you have actually paid to VHN in the twelve months preceding the claim or one hundred dollars ($100). This section does not limit any liability that cannot be limited under applicable law, and it does not modify the limitation-of-liability terms of any executed Client Services Agreement, which govern membership services.
8. Indemnification
You agree to indemnify, defend, and hold harmless Veteran Health Network LLC and its officers, employees, agents, and contractors from and against any claims, losses, liabilities, costs, and reasonable attorneys' fees arising out of or related to your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party, to the extent caused by you.
9. Text Messaging (SMS) Consent
By providing your mobile phone number to VHN through the Site, an intake form, or any communication with our team, you consent to receive text messages from VHN related to your inquiry, intake, scheduling, appointment reminders, and case management.
- Consent to receive text messages is not a condition of purchasing any VHN service.
- Message frequency will vary based on your interactions with VHN.
- Message and data rates may apply.
- Reply STOP at any time to opt out of text messages. Reply HELP for help, or contact legal@myvhn.org.
- Mobile opt-in information, including your phone number and consent status, is not shared with third parties for their marketing purposes.
Opting out of text messages does not affect your membership or any service; VHN will communicate with you by other means on file.
10. Dispute Resolution; Arbitration; Class Action Waiver
Please read this section carefully. It affects your legal rights.
Before commencing any formal proceeding, you agree to first provide VHN written notice of the dispute at legal@myvhn.org and allow 10 business days for good faith informal resolution.
Except for matters properly brought in small claims court or requests for temporary injunctive relief, any dispute arising out of or relating to the Site or these Terms shall be resolved by final and binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. This arbitration provision is governed by the Federal Arbitration Act. Arbitration shall take place remotely unless otherwise required by applicable law or AAA rules. The arbitrator may award any relief available in court on an individual basis.
All disputes shall be brought solely in an individual capacity. You and VHN each waive any right to bring or participate in any class action, collective action, mass action, or representative proceeding, and each knowingly and irrevocably waive any right to a jury trial. If the class waiver is found unenforceable as to a particular claim, that claim shall be severed and all remaining claims shall proceed in individual arbitration.
If you are an enrolled member, disputes concerning your membership are governed by the arbitration agreement in your Client Services Agreement, which is consistent with this section and controls as to membership services.
11. Governing Law
These Terms are governed by the laws of the State of Indiana without regard to conflict-of-laws principles, except to the extent preempted by the Federal Arbitration Act. Nothing in these Terms limits or waives any right you may have under mandatory consumer protection statutes of your state of residence.
12. Changes to These Terms
We may update these Terms from time to time. The Effective Date below reflects the most recent revision. Material changes will be posted on this page. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
