Florida veteran benefits, and the cliff at 65

Florida does not run a graduated schedule. It runs three separate instruments: a flat $5,000 off assessed value at 10 percent or more, on any property; a full homestead exemption at total and permanent; and a discount equal to the veteran's own rating percentage, available only from age 65 and only for a combat related disability.

What is different about Florida

Florida does not run a graduated schedule. It runs three separate instruments with three different shapes. A flat $5,000 off assessed value at 10 percent or more, attaching to any property rather than only a homestead. A full homestead exemption at total and permanent. And, uniquely among the large states, a discount equal to the veteran's own rating percentage, which is gated not on the rating but on being 65 or older with a combat related disability. The practical effect is a cliff that has nothing to do with the claim: a veteran rated 60 percent at 64 gets $5,000 off assessed value, and the same veteran at 65 with a combat related rating gets 60 percent off the homestead bill.

Three instruments, one deadline, and the gate that has nothing to do with the rating

Sections 196.24, 196.081 and 196.082 of the Florida Statutes do three different things and are usually printed as though they were tiers of one thing. The first exempts $5,000 of value for an ex-servicemember disabled to a degree of 10 percent or more, and it is not limited to homestead property. The second exempts the homestead entirely where the service connected disability is total and permanent. The third grants a discount equal to the percentage of the veteran's permanent service connected disability as VA determined it.

The third is the one that catches people, because its gates are not about the rating. A veteran has to be 65 or older and the disability has to be combat related. A veteran rated 60 percent at 64 receives $5,000 off assessed value. The same veteran at 65, with a combat related rating, receives a 60 percent discount on the homestead bill. The birthday is the variable, not the claim.

All three go to the county property appraiser and all three run to a March 1 deadline, but they do not all go on the same form. The $5,000 exemption under 196.24 and the total exemption under 196.081 are both claimed on Form DR-501, the original application for homestead and related tax exemptions. The age 65 combat related discount under 196.082 needs a second form as well, DR-501DV, filed with the county property appraiser, and the homestead exemption in that county is a precondition of it rather than an alternative. Section 196.082 also sets out what has to accompany the claim: an official letter from VA stating the percentage of the service connected disability with evidence reasonably identifying it as combat related, a copy of the honorable discharge, and proof of age as of January 1 of the year the discount applies. Two provisions soften the timing. Under section 196.081 an eligible veteran may apply before the VA documentation arrives, and the exemption takes effect from the original application date once it does. Under 196.082 a late filer may petition the value adjustment board. Refunds under 196.24 are limited to a four year period.

Where the exemption appears on the TRIM notice

The document is the Notice of Proposed Property Taxes, mailed each August by the county property appraiser and universally called the TRIM notice. Its front page is about rates rather than exemptions: taxing authority, last year's taxes, last year's adjusted millage, this year's taxes if no budget change is adopted, this year's millage if the proposed budget is adopted, and this year's taxes if it is. No exemption appears there at all, which is why people conclude theirs was not granted.

The exemptions are on the second page and the statute prescribes what has to be printed. Section 200.069 requires the parcel's market value, and for each taxing authority the assessed value, the value of exemptions and the taxable value for both the previous year and the current year, together with each assessment reduction and exemption applicable to the property.

So the check is specific. Find the taxing authority, compare assessed value to taxable value for the current year, and confirm the difference is the exemption that was granted. If it is not there, the value adjustment board petition window printed on the same notice is the route, and it closes.

Three instruments, three sizes

The $5,000 exemption is a flat slice out of the assessed base, so its worth is $5,000 multiplied by the millage. At an illustrative 20 mills, which is $20 per $1,000 of taxable value, that is $100 a year. It is small, and its value is that it attaches to property that is not a homestead, which few states allow.

The total homestead exemption removes the ad valorem bill on the homestead entirely, so its worth is whatever that bill would have been.

The age 65 discount is the only one of the three where the rating number is the math rather than a threshold. A 40 percent rating is a 40 percent discount, a 70 percent rating is a 70 percent discount. On a mid sized homestead bill that is a materially larger figure than the flat $5,000 exemption at the same rating, which is why the birthday matters as much as it does.

One free entitlement carries no rating threshold at all. Section 258.0145 directs that honorably discharged veterans with service connected disabilities receive lifetime family annual entrance passes to state parks at no charge, with no minimum percentage in the statute. Surviving spouses and parents of members who have fallen in combat receive the same. The dollar value of the equivalent paid pass is published on a non government site and is therefore not stated here.

Total homestead exemption

Has to be applied for once

Florida exempts from ad valorem taxation real estate owned and used as a homestead by a veteran honorably discharged with a service connected total and permanent disability. A similar exemption applies to disabled veterans confined to wheelchairs.

  • The exemption carries over to the veteran's spouse until the spouse remarries or sells or otherwise disposes of the property.
  • On a sale the spouse may transfer an exemption not exceeding the amount granted on the most recent tax roll to a new residence.
  • Where the property is acquired between January 1 and November 1, the statute provides a prorated refund of taxes paid.

Percentage discount for veterans aged 65 and over

Has to be applied for once

Florida grants a homestead ad valorem discount to each veteran aged 65 or older who is partially or totally permanently disabled from a combat related disability and was honorably discharged. The discount is a percentage equal to the percentage of the veteran's permanent service connected disability as VA determined it.

  • Two gates that have nothing to do with the rating: the veteran must be 65 or older, and the disability must be combat related.
  • The discount carries over to a spouse holding legal or beneficial title who permanently resides there and has not remarried, and it transfers to a new primary residence.
  • A late filer may petition the value adjustment board.
What it is worth
The rating percentage, applied to the homestead bill A 40 percent rating gives a 40 percent discount on the ad valorem bill. It is the only instrument among the large states where the rating number itself is the math rather than a threshold.

Free disabled veteran license plate

Has to be applied for once

Florida provides one free disabled veteran motor vehicle license plate to an honorably discharged veteran with a service connected 100 percent disability rating.

  • One plate only, transferable to another vehicle the veteran owns.
  • A service charge for registration and a 50 cent fee per plate and validation sticker still apply.
  • A qualifying veteran who instead elects a military or specialty plate pays all fees applicable to that plate except those otherwise waived.

Licenses and parks

Lifetime family annual entrance pass to state parks

Has to be applied for once

Florida directs that honorably discharged veterans with service connected disabilities receive lifetime family annual entrance passes to state parks at no charge. The statute sets no minimum rating percentage.

  • Any service connected disability reaches it. There is no percentage threshold in the statute.
  • Surviving spouses and parents of members of the armed forces, National Guard or reserves who have fallen in combat also receive free lifetime family passes.
  • Active duty members and honorably discharged veterans generally receive a 25 percent discount on annual entrance passes.
  • Documentation has to be presented in person.

Education

Scholarships for children and spouses of disabled veterans

Has to be claimed again each year

Florida provides scholarships at state expense at eligible Florida postsecondary institutions for children and spouses of servicemembers who died from service connected causes or hold a service connected 100 percent total and permanent disability rating.

  • Children must be between the ages of 16 and 22.
  • Unremarried spouses of deceased servicemembers qualify, as do spouses married at least one year to a qualifying disabled servicemember.
  • It covers tuition and registration fees, board, room rent, books and supplies, for up to 110 percent of the required credit hours of an initial baccalaureate degree or certificate program.
  • Florida must have been the servicemember's official home of record, or the child must otherwise qualify as a resident for tuition purposes.

Florida requires the state and its political subdivisions to give preference in appointment and retention to disabled veterans, to spouses of veterans with a total permanent service connected disability, to wartime veterans, and to unremarried surviving spouses of veterans who died of service connected disabilities.

Does the Florida $5,000 exemption have to be on a homestead?

No. Section 196.24 is not limited to homestead property. The total exemption under 196.081 and the age 65 discount under 196.082 both are.

What does combat related mean for the age 65 discount?

Section 196.082 requires the veteran to be partially or totally permanently disabled from a combat related disability and to have been honorably discharged. The statute uses that phrase; the property appraiser applies it against the VA determination.

Can a Florida veteran apply before the VA paperwork arrives?
