Chapter 35 Payment Rates and Months of Entitlement

VA's published rates for institutional training, meaning study at a school, took effect October 1, 2025 and cover the period through September 30, 2026.

Full time is $1,574.00 per full month. Three-quarter time is $1,244.00 per full month. Half time is $912.00 per full month.

VA states each of those as an amount per full month, and the level is set by how much training the person is doing rather than by what the course costs. These figures are replaced on a schedule, so a Chapter 35 rate quoted anywhere without an effective date beside it is not usable.

36 months where the school or training started on or after August 1, 2018. 45 months where it started before that date.

The trigger is the date the training started. Not the date the veteran was rated. Not the date VA granted eligibility. Not the date of the veteran's death. This catches people out in a specific and predictable way: someone whose eligibility was established in 2016 and who enrolls in 2024 is in the 36-month group, because the enrollment is what the rule looks at.

That is nine months of full-time payment between the two answers, which at the rate effective October 1, 2025 is a difference worth more than fourteen thousand dollars.

Because the regulation does.

38 CFR 21.3044(a) reads 'not in excess of 45 months', and it has read that way since it was last amended at 61 FR 26109 on May 24, 1996. VA's published guidance says 36 for training started on or after August 1, 2018. The two do not agree, and VA's current guidance is what governs the payment.

This is worth understanding rather than just accepting, because it explains a pattern. A writer who wants to be careful goes to the Code of Federal Regulations, finds 45, cites it, and publishes something wrong. Doing the diligent thing produces the stale answer. Anyone can check both in about a minute: the regulation is on eCFR with its amendment history attached, and VA's figure is on the Chapter 35 rate page.

No, and the regulation says so directly. 38 CFR 21.3044(b): 'The 45-month period of entitlement is any 45 months within the period of eligibility. The eligible person is not required to pursue his or her program for 45 consecutive months.'

The month count in that sentence is the stale one. The principle in it is not. Entitlement is a bank of months to be drawn down inside whatever eligibility period applies, and stopping for a term, a year or longer does not forfeit what is left of it.

The eligibility period is a separate question with a separate answer, and for a large group of people there is now no time limit on it at all. That is set out on the Chapter 35 eligibility page.

There is a ceiling across programs. 38 CFR 21.3044(a) states that combined entitlement will not exceed 48 months of full-time educational assistance.

So 36 months of Chapter 35 does not sit alongside a full separate entitlement under another VA education program. The 48-month figure is the outer limit on the total, and it is one of the few numbers in this part of the regulation that has not gone stale.

VA does not publish a total, so here is the math, labeled as math. 36 full months at the full-time rate of $1,574.00, effective October 1, 2025, is $56,664.00.

That number will not be what anybody receives, and the reasons are worth more than the number. Rates are replaced on a schedule, and a course that runs across four academic years will be paid at more than one rate. Time spent below full time is paid at the three-quarter or half-time figure instead. And months are only paid while somebody is enrolled.

Treat it as the size of the thing rather than a forecast. The point of running it is that a family deciding whether the paperwork is worth doing usually has no sense of the scale, and the monthly figure on its own does not give them one.
